Personal Injury - Frequently Asked Questions
Legal systems are very different between different countries.
If you have been injured in a foreign jurisdiction (i.e. outside England or Wales), then you may well need to seek advice on your potential compensation claim from a lawyer in the country concerned. This would even apply to accidents in Scotland, as Scotland has a completely different legal system to England and Wales.
The MAIN EXCEPTION to the situation described above arises in circumstances where you live in England or Wales and your proposed personal injury claim relates to an accident which occurred at a time when you were on a Package Holiday. In this kind of case, you may have a claim against the Tour Operator which could still be brought under in England or Wales under legislation that covers Package Holidays, even if your injuries have, for example, been suffered in an apartment or hotel whilst abroad, on a plane or even at the airport. If successful, such a claim might also include an additional element of compensation to reflect the disappointment for a ruined holiday.
