HOW DO YOU CLAIM COMPENSATION FOR INJURIES CAUSED IN AN ACCIDENT TO A CHILD, INFIRM OR MENTALLY DISABLED PERSON ?

In these cases, an independent person known as a “Litigation Friend” would pursue the claim on behalf of the injured person.

In the case on an injured child, the “Litigation Friend” would usually be one of the parents of the child – provided that there is no actual of potential conflict of interest between the child and the parent.

In the case of an infirm or mentally disabled person, the “Litigation Friend” would usually be a close relative / full time carer. If the injured person is subject to the protection of the Court of Protection, then the “Litigation Friend” would be the Receiver appointed by the Court of Protection.
