Personal Injury - Frequently Asked Questions
HOW LONG WILL MY CLAIM TAKE ?
This all depends on a number of factors – such as the type of accident in which you were injured, the nature and severity of your injuries, how long it takes you to recover, whether fault for the accident is accepted by the other side, whether Court Proceedings need to be issued and, to some extent, upon how cooperative the insurers of the other side are. However, for our part, we do not allow any avoidable delays – for example, if the other side are trying to drag the claim out, we will issue formal civil proceedings in Court in order to put pressure on them.
It is extremely important to remember that it is not in your interests to settle a claim too early if you have not fully recovered, as claims are settled on a “once and for all” basis – i.e. you cannot have a “second bite of the cherry” in order to seek more compensation either if you do not recover as anticipated or even if your medical condition deteriorates in a manner which was not anticipated at the time of your claim being settled.
It normally takes between 1 to 3 years to finalise the settlement of claims.
