Personal Injury - Frequently Asked Questions

DO I HAVE A CLAIM ?

Each case is different. When we have assessed the individual facts of your case, we will be able to advise whether or not you have a claim.

As a general rule, if you have had an accident within the last three years that was not your fault, you could be entitled to compensation.

It is, however, important to remember that, sometimes, an accident is just that – an accident for which nobody was actually to blame. In most circumstances in England and Wales you can only claim compensation if somebody else is legally to blame for your accident. You must also have suffered some actual loss (for example, personal injury, damage to your belongings and / or loss of earnings) because, by law, you cannot claim compensation just for the nasty experience of being involved in an accident. It is also important to establish that the person or organisation against whom you intend to pursue a claim for compensation would be likely to have the necessary financial resources to pay in the event of your claim being successful (often through their insurers)

There are many different circumstances in which somebody may be to blame for an accident and in which the victim of that accident may be entitled to claim compensation, and so if you have been injured in an accident you would be well advised to speak with one of our Specialist Personal Injury Solicitors for a initial assessment of the circumstances of your particular situation.
